Severability

Fair Housing

attempts to post discriminatory ads may be blocked and/or subject to
prosecution.

headings used in these Terms and Conditions are for reference only and
the convenience of the users and shall not constitute part of these
Terms and Conditions for interpretation purposes.
Change of Terms
These Terms and
Conditions may be changed at anytime with or without prior notice to
you. Your continued access or use of this website after the Terms and
Conditions have changed indicates your acceptance and understanding of
the new Terms Conditions and you acknowledge, agree, consent and
understand that you are bound by the Terms and Conditions currently
present. If you do not agree with the new Terms and Conditions, then
your only recourse is to not access the website or stop using the
website. DIYHomesellers.com always recommends that you access and read
these Terms and Conditions each time you visit the website.
Electronic Receipt
Subscribers
will be given, via e-mail or hard-copy, electronic receipts that support
charges for use of the Services or Products.

Activation/Subscription & User Access

activating your account or registering/subscribing to the services
(including forums and message boards) with DIYHomesellers.com, you agree
to all policies and disclaimers. Upon requesting activation of an
account, you are required to accept these policies, guidelines and
disclaimer, and a copy of your acceptance is forwarded electronically
along with your activation request to be maintained with your account
information. Should you register or subscribe to the Services, Products
or Advertisements on the website or any third-party Services, Products
or Advertisements then you acknowledge, agree and understand that you
are fully liable and responsible for any and all actions that takes
place under your account, username/password, I.D., advertisement number, or
e-mail address. It is strictly prohibited to assign, loan, sell, or
transfer your account information, privileges and rights. It is your
sole responsibility to protect and safeguard your account,
username/password, I.D., advertisement number, and e-mail address in full.
DIYHomesellers.com disclaims and responsibility or liability relating to
the misuse or mistreatment of your Account should you allow other
individuals to access and/or use your Account. If allow other
individuals or users to access or use your Account then it is understood
that DIYHomesellers.com reserves the right to cancel, delete, disable or
terminate your Account or subscription at our discretion. It is in your
best interest that you notify us immediately if you believe or know of
individuals or users who may have accessed or used your Account or

remains inactive for a period of one year (from the date of activation)
then DIYHomesellers.com reserves the right to close, disable, delete,

Responsibilities

setting up your account. In consideration of your use of the

current, and complete information about yourself as prompted by
the website's Registration Form(s) [including forums, message
boards, sweepstakes and contests], and (b) maintain and promptly update
the registration information to keep it true, accurate, current, and
complete. If you provide any information that is untrue, inaccurate, not
current, or incomplete, or DIYHomesellers.com has reasonable grounds to
suspect that such information is untrue, inaccurate, not current, or
incomplete, DIYHomesellers.com reserves the right to cancel, delete,
suspend or terminate your account/subscription and refuse any and all
current or future use of the website, or any portion thereof.
Furthermore you also acknowledge and agree that you are at least
eighteen (18) years old and/or of legal age to form a legally binding
contract. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) OR NOT OF LEGAL AGE
TO FORM A LEGALLY BINDING CONTRACT THEN YOUR ONLY RECOURSE IS TO NOT
REGISTER FOR OUR SERVICES AND STOP USING THE WEBSITE. You are solely
responsible for all acts, requests or omissions that occur under your
e-mail address, advertisement number, username/password, including the
accuracy and completeness of all content that you (or anyone using your
Account) post, submit, or transmit through the services.
Advertisement Syndication on Other/Third-Party Websites
All DIYHomeSellers.com advertisement plans (both paid and free) include property advertisement syndication on other/third-party websites.
This means we will submit your property advertisement from DIYHomeSellers.com for advertisement and marketing on various other websites
that are external to our website. Upon signing up for our services or plans you agree, consent and understand that you give permission
to DIYHomeSellers.com to submit your property on other/third-party websites for addition on their site. YOU ARE NOT SUBSCRIBING TO
AND/OR PURCHASING ANY TYPE OF SERVICE OR LISTING PLAN WITH THE OTHER/THIRD-PARTY WEBSITE AS PART OF THE SERVICE FEE YOU PAY TO
DIYHOMESELLERS.COM.
Furthermore, you also agree, consent and understand that if a third-party website declines your property advertisement for any reason, you have no remedy against DIYHomeSellers.com. In addition, the particular other/third-party websites to which DIYHomeSellers.com will submit your property advertisement information are subject to change without notice to you. IF YOU OPPOSE ANY CHANGES TO THE LIST OF THE OTHER/THIRD-PARTY WEBSITES TO WHICH YOUR PROPERTY LISTING IS SUBMITTED, YOUR ONLY REMEDY SHALL BE TO TERMINATE USING THE SERVICES WITH NO REFUND OF ANY PAID MONIES. In addition, other/third-party websites owned or operated by third parties are not under the control of DIYHomeSellers.com. Consequently, DIYHomeSellers.com cannot guarantee that your property advertisement information (including images, advertisement price, description, etc) associated with your property advertisement will appear on any particular third-party website or will appear in a certain way on such third-party website. Further, we are not responsible for any changes, modifications or updates made to third-party websites. YOU AGREE, CONSENT AND UNDERSTAND THAT DIYHOMESELLERS.COM SHALL HAVE NO LIABILITY AT ALL CONCERNING CLAIMS RELATING TO (a) THE SUBMISSION OF YOUR PROPERTY LISTING(s) INFORMATION TO, OR (b) THE USE, DISPLAY, OR VARIATION OF YOUR PROPERTY LISTING INFORMATION ON OR BY OTHER/THIRD-PARTY WEBSITES YOUR ONLY REMEDY FOR SUCH CLAIMS SHALL BE TO TERMINATE USING THE SERVICES WITH NO REFUND OF ANY PAID MONIES.
Billing
Concerning Service Plans and Customer Responsibilities Regarding
Advertisements
Customers
participating in or using the Services are bound under the terms of this
section and more specifically the Terms and Conditions of this website.
Below you will find package explanations and billing related
information; by enjoying, registering, subscribing or using the Services
you hereby agree, consent and understand to the following regarding the
plan you chose:
I.
Month
by Month Package Plans
DIYHomesellers
offers Month-By-Month Package Plan(s).
Any customer who registers for month-by-month plan is responsible for
paying monthly subscription fees every thirty (30) days, based upon the
price indicated by the Website per month; this is a recurring fee. You
acknowledge, agree, consent and understand that all Services under this
plan are rendered at the end of thirty (30) days from the date of
subscription/registration. At the end of your subscription/registration
date you will automatically renewed and thus beginning a new
subscription/registration period; your ad will continue to renew via
automatic credit card charge (recurring billing) until we receive a
cancellation request via e-mail or the advertisement is cancelled online
through the user administration area at least one (1) business day prior
to the renewal date to the e-mail listed below, or you can call us at
the number below. Should you cancel before or after your advertisement period
is completed or expired then you understand that you will not receive
any refund, nor will you will receive any partial or prorated refund.
Finally, you understand and agree that it is your sole responsibility to
cancel your ad as described above; should you fail to do so you are
liable and responsible to pay DIYHomesellers.com all related monthly
fees. If you wish to cancel your advertisement and receive a refund, we
must receive a written request within the first twenty-four (24) hours
of registration. If twenty-four (24) hours have passed then you agree
and understand that you are not eligible to receive any type of refund.
Direct all e-mail cancellation requests to support@DIYHomesellers.com
or call 1-877-224-6607. You must receive a confirmation from us, either
via electronic mail or over the telephone, or your advertisement has not been
canceled. If you have not received a confirmation, you must cancel your
advertisement online through the user administration area. DIYHomesellers.com
reserves the right to charge the customer a surcharge not to exceed
$65.00 for the customer's failure to properly remove the advertisement after
the property is sold, thus requiring DIYHomesellers.com to remove the
advertisement itself.
NOTE: Certain
packages include signs, directional signs, brochure holders and other
products that will be shipped to you. Normally these products are
shipped within twenty-four hours, so if these products have already been
shipped before you cancel your Account under these terms, then you
agree, acknowledge, consent and understand that it is your sole
responsibility to return the products in unused condition; you are
responsible for all shipping costs and, furthermore you acknowledge,
agree, consent and understand that you are subject to pay a surcharge
not to exceed $50 for a re-stocking fee.
Should you wish to upgrade from a lower package plan to an MLS package
plan, an additional fee of between $300 to $700 (depending on your
previous plan) will be charged. This fee is a one time-flat fee and is
not a recurring monthly fee.
II.
Until Sold Package
Plans
Any customer who registers for an 'Until Sold' plan will be billed a
one-time flat fee based upon the price indicated by the Website. You
acknowledge, agree, consent and understand that Services under this plan
are considered rendered after three (3) months have elapsed; after three
(3) months have elapsed you will be sent an e-mail to your registered
e-mail account which will be used to renew your ad another three (3)
months at no charge, this process will remain the same until you cancel
the ad or remove the ad online. In order to cancel your Service plan you
can either: (a) Do not respond to the renewal e-mail, (b) send an e-mail
to support@DIYHomesellers.com
at least one [1] business day prior to renewal date, (c) call
1-877-224-6607 or (d) cancel your advertisement online through the user
administration area. Should you cancel before or after your advertisement
period is completed or expired then you understand that you will not
receive any refund, nor will you will receive any partial or prorated
refund. If you wish to cancel your advertisement and receive a refund, we
must receive a written request within the first twenty-four (24) hours
of registration. If twenty-four (24) hours have passed then you agree
and understand that you are not eligible to receive any type of refund.

III.
Featured
Homes
For plans which include 'Featured Home', the site rotates your property
advertisement through the "Featured Home (homepage)" section of the
DIYHomesellers.com homepage at periodic times; property advertisement is in
rotation for a total of fifteen (15) days on the homepage and thirty
(30) days at the top of the local search homepage. Due to the fact your
property advertisement rotates with many other homes, the picture of your
property advertisement will not be viewable all of the time and may not be
present during certain times when you check the "Featured Home
(homepage) or local homepage." You acknowledge, agree, consent and
understand that you are not entitled to a refund because your property
advertisement was not displayed as a "Featured Home (home page)" or Local
Featured Home at a certain time.
V.
Multiple
Listing Service (MLS) package plans
MLS
package plan includes working with DIYHomesellers.com to find a local
real estate broker to list your home on the local MLS.
Signing up with the Multiple Listings Service allows only three photo
images of a property to be displayed (in addition to those that may be
displayed on the DIYHomesellers.com site). If you register for an MLS
plan, you acknowledge, agree and understand that the DIYHomesellers.com
website advertisement and MLS Service/advertisement are activated separately. MLS
advertisement applications must be submitted promptly after receipt by a
customer; hesitation may cause your contract to be delayed or even
rejected. All Customers who purchase an MLS plan are responsible for
correctly completing all paperwork necessary and applicable to their
local MLS prior to their ad becoming viewable in their local MLS. There
may be a delay (usually 5 to 7 business days) in the activation of the
MLS listing; you are advised to consult the listing real estate
broker/agent in your area for further details. DIYHomesellers.com is not
a licensed real estate broker/agent and does not provide real estate
brokerage services in connection with your property listings.
Accordingly, all MLS listings are handled by an independent, local real
estate broker/agent in your area who will contact you in order to
contract with you separately, and that broker/agent will activate your
MLS listings for you. The terms and conditions of any agreement between
you and any independent real estate broker/agent are not endorsed,
recommended or otherwise known to or by DIYHomesellers.com, LLC. All MLS
listings require you to sign a seller's/buyer's agency commission (flat
fee or commission percentage) if a real estate broker assists you in
finding a buyer. Neither the Service nor these Terms and Conditions are
a solicitation for a listing broker if your property is already listed
with a broker. All charges and fees relating to your MLS listing should
be taken up with your listing brokerage and chosen/assigned real estate
agent; DIYHomesellers.com disclaims any liability or responsibility for
all charges and fees you incur during the MLS process (including but not
limited to surcharges, commissions, escrow and closing fees).
The MLS service expires
with your listing broker after 180 days from the listing date. Should
you wish to renew your advertisement for an additional 180 days then you must
contact us at least seven (7) business days prior to expiration; an
additional charge of $200 will be required to extend the advertisement.
Variances in
Availability Prices
Prices
quoted on the website are for Internet purchases only, and prices may
vary by sales channel (e.g., telephone orders & fax) or zip code. In
addition, prices may vary by service plan depending on specials,
discounts, or rebates that may be in effect at any given time. Some or
all plans listed may not be available in all areas or zip codes. Please

Trial Rules and Regulations
Periodically, DIYHomesellers.com may offer a seven or ten day free trials of our Basic Plan (Plus) Services. By participating in,
using or enjoying the free trial you acknowledge, agree, consent and understand that you are fully bound under these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions then your only recourse is to end your free trial and stop using the website
immediately. Additionally, you understand, agree and acknowledge that you will not reuse any seven or ten day free trial codes more than one
time OR use free trials for more than one property advertisement. Furthermore, you also understand, agree and acknowledge that you will not use a
free trial or free trial access code more than one time for the same property. You agree that we may cancel, delete, disable or terminate your
user access to the Services and your customer Account and password, or delete, remove and discard any content posted by you on or through the
Services, with or without notice to you, if we believe that you have violated or acted inconsistently with this particular section and these
Terms and Conditions.
Bulk Advertisement
Accounts: DIY Homebuilders and Realtors Advertisement Program
To
better serve our clients and help promote the future of the real estate
industry, DIYHomesellers.com reserves the right to partner up with
Builders and Realtors to help promote and advertise their advertisements
through our website. Builders and Realtors acknowledge, agree, consent
and understand that DIYHomesellers.com is not a licensed real estate
broker; we offer advertising and marketing services for your advertisements.
In order to create a Builder or Realtor Bulk Advertisement Account (Frequent
User/Multiple Advertisements) you need to fill out our online request form for
approval; you can do so by clicking this link: http://diyhomesellers.com/advertise-with-diyhomesellers.
Upon background approval and payment in full (see details below) your
Bulk Advertisement Account will be created and available for use.
Billing and charges related to the Builder/Realtor Bulk Advertisement Account is
as follows. Builders or Realtors may list their property(s) on the
DIYHomesellers.com website for a six-month period at a flat-fee rate of
$600. This flat-fee includes: (a) All of the features of the "Basic
Package Plan" (see explanation above) PLUS, (b) E-mail alerts when
someone shows interest in your advertisement online and (c) Your advertisement is
also placed many other websites such as Yahoo.com, Military.com,
fsbotopics.com, topfsbo.com, Lycos.com, Oodle.com, Google.com,
buylistsale.com, fsbopad.com, sold-it-alone.com and many more! You agree
and understand that your Bulk Advertisement Account does not include the
Featured Home or Local Featured Home status. Additionally, advertisements that
include commercial or personal advertisements or links (i.e., personal
website links, MLS website links, etc) will automatically be deleted.
DIYHomesellers.com reserves the right to terminate or delete any Account
with violates these guidelines and you understand and agree you are not
entitled to any refund under this condition.
Although
the Builder/Realtor Bulk Advertisement Account is an "6 month" plan you
acknowledge, agree, consent and understand that Services under this plan
are considered rendered after three (3) months have elapsed; after three
(3) months have elapsed you will be sent an e-mail to your registered
e-mail account which will be used to renew your ad another three (3)
months at no charge, this process will remain the same until you cancel
the ad or remove the ad online. In order to cancel your Service plan you
can either: (a) Do not respond to the renewal e-mail, (b) send an e-mail
to support@DIYHomesellers.com
at least one [1] business day prior to renewal date, (c) call
1-877-224-6607 or (d) cancel your advertisement online through the Bulk advertisement
administration area. Should you cancel before or after your advertisement
period is completed or expired then you understand that you will not
receive any refund, nor will you will receive any partial or prorated
refund. If you wish to cancel your advertisement and receive a refund, we
must receive a written request within the first twenty-four (24) hours
of registration. If twenty-four (24) hours have passed then you agree
and understand that you are not eligible to receive any type of refund.
DIYHomesellers.com reserves the right to charge the customer a surcharge
not to exceed $65.00 for the customer's failure to properly remove the
advertisement after the property is sold, thus requiring DIYHomesellers.com to
remove the advertisement itself.
NOTE:
Certain
packages include signs, directional signs, brochure holders and other
products that will be shipped to you. Normally these products are
shipped within twenty-four hours, so if these products have already been
shipped before you cancel your Account under these terms, then you
agree, acknowledge, consent and understand that it is your sole
responsibility to return the products in unused condition; you are
responsible for all shipping costs and, furthermore you acknowledge,
agree, consent and understand that you are subject to pay a surcharge
not to exceed $50 for a re-stocking fee.
Participating In or
Using the Automated E-mail System
To
better serve and assist our sellers and buyers in communicating
throughout the real estate process DIYHomesellers.com allows potential
buyers' to send e-mails to our sellers' to ask questions or show
interest in their property/advertisement. In using this automated e-mail
service to contact our customers and our company you are bound under all
these Terms and Conditions. Furthermore you fully acknowledge, agree,
consent and understand that you are only using the automated e-mail
system for (a) contacting customers about a question regarding their
advertisement, (b) contacting customers about the potential purchase of their
advertisement, (c) or to contact DIYHomesellers.com about a question relating
to the website or Services. Should you misuse the automated e-mail
system to establish a commercial relationship of any kind with the
seller and/or verbally abuse or slander the customer or
DIYHomesellers.com then you agree, acknowledge, consent and understand
that you shall compensate DIYHomesellers.com for liquidated damages in
the amount of $15,000 per occurrence.

and Direct Mail From Us, Third-Parties and Other Companies
Periodically,
DIYHomesellers.com our affiliates, sponsors and advertisers may choose
to send you e-mails regarding promotions, special discount codes,
helpful newsletters, service upgrades or products that may be of
interest to you or aid in the sale of your property. Upon
registering/subscribing for our Services or Products (including Message

user that accesses your Account then it is your sole responsibility to
immediately notify us of any such suspicion or security breach. If you
fail to satisfactorily protect, secure and/or safeguard your e-mail
address, I.D., advertisement number, password and/or username then
DIYHomesellers.com disclaims any and all responsibility or liability for
any loss or damage arising therein. Finally, you agree that we may
cancel, delete, disable, or terminate your Account if it remains
inactive for a period of three-hundred sixty-five (365) calendar days
starting from the date you begin using our services.

Abuse and Server Uptime Guarantee

attempt to undermine or cause harm to a server or customer of

numbers, and e-mail addresses. Should you violate the Terms and
Conditions outlined within, your account(s) will be cancelled without
chance of refund; you will also be charged a penalty for liquidated
damages in the amount of $50,000 or prosecuted to fullest extent.
Although DIYHomesellers.com has an excellent record for reliability, we do not offer an uptime server guarantee. However, our network and servers are monitored continuously, and are rarely down except for scheduled maintenance and hardware and software upgrades. and State Advertising Opportunities

The cost for ad space is variable and based on the number of categories
you wish to advertise in, but will never exceed forty ($40) per month

$80 per month for ad space). Billing for advertisement space will be
paid through online credit card deduction. As an ad space

(a) Ad space service is rendered for a period of thirty (30) days, (b)
All ads are automatically renewed after every thirty (30) day cycle,
meaning your credit card will be charged every thirty (30) days until
you cancel your ad account, (c) You will/must provide a written
cancellation request at least three (3) business day prior to the end of
your billing cycle and (d) In order to receive any refund you must
cancel your ad service in writing within the first twenty-four (24)
hours of payment. After twenty-four (24) hours have passed no refunds or

Service Fees
Certain
services carry a setup fee charged by DIYHomesellers.com to client,
which must be paid by client in order to have use of said services. If
client terminates this agreement, client shall be responsible for any
and all outstanding fees owed to DIYHomesellers.com and agrees to pay
any and all fees incurred by client. Due to the fact the Services are
provided on a monthly or quarterly basis, the client will be responsible
for Service fees incurred each month or quarter, regardless of when
client provides notice of termination. Thus, for example, if the client
provides notice of termination on the 15th day of a particular month,
the client will be responsible for Service fees for the entire month,
and such fees will not be pro-rated or refunded.

Deactivations
Any
account deactivated due to non-payment will require a reactivation fee
of $20.00 prior to reactivation.
Refusal
of Service
We
reserve the right to refuse, cancel or suspend service to anyone, at our
sole discretion at anytime and with or without prior notice to you.

All complaints will be investigated promptly. Failure to follow any term
or condition will be grounds for immediate account deactivation.
